Acceptable Use Policy

Overview

This Acceptable Use Policy ("AUP") governs your use of Love It and Buy It's services operated by DNS Publishing, LLC DBA loveitandbuyit.com ("Company", "we", "us", or "our"). By using our Service, you agree to comply with this AUP and use the Service only for lawful purposes.

Violations of this AUP may result in temporary suspension, permanent termination of your account, legal action, and reporting to law enforcement authorities.

1. Prohibited Activities

You may not use the Service to:

• Intellectual Property: Infringe upon or violate intellectual property rights, copyrights, trademarks, patents, or other proprietary rights

• System Interference: Interfere with, disrupt, or create undue burden on the Service, servers, or networks

• Data Mining: Scrape, data mine, harvest, or extract information without express written permission
• Reverse Engineering: Reverse engineer, decompile, disassemble, or attempt to derive source code of the Service

• Multiple Accounts: Create multiple accounts to abuse trial periods or evade restrictions
• Reselling: Resell or redistribute the Service without authorization

2. Marketplace Compliance

You must comply with all policies, guidelines, terms of service, and community standards of the marketplaces you connect to our Service, including but not limited to:

• eBay: User Agreement, Selling Policies, and Prohibited and Restricted Items Policy
• Amazon: Services Business Solutions Agreement, Seller Code of Conduct, and Product Listing Policies
• Walmart: Marketplace Retailer Agreement and Prohibited Products Policy
• Etsy: Terms of Use, Seller Policy, Prohibited Items Policy, and Handmade Policy
• TikTok Shop: Seller Terms, Community Guidelines, and Prohibited and Restricted Products Policy

Important: Violations of marketplace policies may result in suspension or termination of your Love It and Buy It account, even if not directly caused by our Service. You are solely responsible for maintaining compliance with all marketplace requirements.

3. Prohibited Products & Services

You may not use the Service to list, sell, promote, or facilitate the sale of:

• Illegal drugs, controlled substances, drug paraphernalia, or prescription medications
• Weapons, firearms, explosives, ammunition, or dangerous materials (except where explicitly permitted by marketplace)
• Counterfeit, replica, or knock-off items that infringe intellectual property rights
• Stolen property or items obtained through theft or fraud
• Products that violate patents, trademarks, copyrights, or trade secrets
• Hazardous, dangerous, or recalled products
• Adult content, services, or sexually explicit materials
• Tobacco products or vaping devices (where prohibited)
• Live animals or animal parts from endangered or protected species
• Human body parts, fluids, or remains
• Hate speech materials, Nazi memorabilia, or items promoting violence or discrimination
• Gambling services, lottery tickets, or illegal gaming items
• Unlicensed financial services, pyramid schemes, or multi-level marketing scams
• False or misleading products (e.g., fake diplomas, certificates, miracle cures)
• Products designed to circumvent copyright protection or digital rights management

4. Account Security & Responsibility

You are responsible for:

• Maintaining the security and confidentiality of your account credentials, passwords, API keys, and OAuth tokens
• All activities that occur under your account, including actions by employees, contractors, or unauthorized users
• Notifying us immediately at security@loveitandbuyit.com of any unauthorized use, security breach, or suspicious activity
• Using strong, unique passwords (minimum 12 characters with uppercase, lowercase, numbers, and special characters)
• Enabling two-factor authentication (2FA) when available
• Not sharing your account, credentials, or access with unauthorized individuals or entities
• Logging out of your account when using shared or public computers
• Keeping your contact information current and accurate

5. Rate Limits and Fair Use

You agree to:

• Stay within the usage limits, quotas, and restrictions of your subscription plan
• Not attempt to circumvent, bypass, or disable rate limits or plan restrictions
• Not use excessive bandwidth, storage, computing resources, or API calls beyond your plan limits
• Not automate account creation or abuse free trial periods
• Not use the Service in a way that negatively impacts other users' experience or Service performance
• Not launch denial-of-service attacks or flood the Service with requests
• Upgrade to a higher-tier plan if your usage consistently exceeds your current plan limits

Fair Use Policy: We reserve the right to throttle, suspend, or terminate accounts that use resources in a way that is unreasonable, excessive, or abusive, even if within stated limits.

6. Content Responsibility

You are solely responsible for:

• All product listings, descriptions, titles, images, and content created through the Service
• Accuracy, truthfulness, and completeness of product information, pricing, and specifications
• Compliance with consumer protection laws, truth-in-advertising regulations, and FTC guidelines
• Proper labeling, warnings, and disclosures required by law or regulation
• Honoring advertised prices, promotions, and guarantees
• Fulfillment of orders, shipping, delivery, and customer service
• Handling returns, refunds, exchanges, and chargebacks
• Paying all applicable taxes, duties, fees, and reporting requirements
• Maintaining adequate inventory to fulfill orders
• Providing clear and accurate shipping times and costs

7. Examples of Violations

The following are examples of activities that violate this AUP:

• Listing counterfeit designer handbags, watches, or clothing
• Selling products with false claims (e.g., "cure cancer", "lose 50 lbs in 1 week")
• Using copyrighted images without permission
• Creating fake reviews or manipulating marketplace ratings
• Dropshipping prohibited items or items from unauthorized suppliers
• Price gouging during emergencies or disasters
• Bait-and-switch tactics (advertising one product, delivering another)
• Using misleading keywords or tags to game search algorithms
• Selling recalled products without proper disclosure
• Operating multiple accounts to circumvent marketplace bans
• Using automation to manipulate prices or engage in predatory practices

8. Reporting Violations

If you become aware of any violation of this AUP, intellectual property infringement, illegal activity, or abuse of the Service, please report it to us immediately:

DMCA Takedown Notices: If you believe your copyrighted work has been infringed, submit a DMCA takedown notice to dmca@loveitandbuyit.com with: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) your contact information, (4) a statement of good faith belief, (5) a statement of accuracy under penalty of perjury, and (6) your physical or electronic signature.

9. Enforcement & Consequences

We reserve the right to investigate suspected violations and take appropriate action:

• Warning: Issue warnings for minor or first-time violations
• Content Removal: Remove, disable, or block access to content that violates this AUP
• Account Suspension: Temporarily suspend accounts pending investigation
• Account Termination: Permanently terminate accounts for serious or repeated violations
• Legal Action: Pursue legal action, including injunctions, damages, and costs
• Law Enforcement: Report violations to law enforcement, regulatory authorities, or marketplace platforms
• Cooperation: Cooperate with investigations and provide information as required by law

No Refunds: Accounts terminated for AUP violations are not eligible for refunds of subscription fees.

We are not obligated to monitor all user activity but reserve the right to do so. We are not liable for user-generated content or third-party actions.

10. Cooperation with Marketplaces

We may cooperate with marketplace platforms (eBay, Amazon, Walmart, Etsy, TikTok Shop) to investigate and address policy violations. This includes:

• Sharing information about account activity and violations
• Suspending Service access if your marketplace account is suspended or terminated
• Implementing restrictions required by marketplace platforms
• Responding to marketplace platform inquiries and requests

11. Changes to This Policy

We may update this AUP from time to time to reflect changes in laws, regulations, our practices, or marketplace requirements. Material changes will be communicated via email or platform notifications.

Continued use of the Service after changes constitutes acceptance of the updated AUP. It is your responsibility to review this AUP periodically. We will update the "Last Updated" date at the top when changes are made.

12. Severability

If any provision of this AUP is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
